Application Terms
The applicant is bound by the Terms and Conditions herein upon submission of your certification application to the BizCert Assessment and Certification unit.
Accredited applicant must not have five (05) or more complaints lodged against the business with breaches of Consumer Protection Fair Trading Act and must have practiced consistent clean track record with the Association of Trade & Commerce (Singapore) and the other relevant governing authorities.
Businesses with branches, outlets or representative office that operates under different unique entity number (UEN) are considered as a sole operating entity and such application will be required to be conducted on a separated application basis.
Application fee are non-transferable, non-refundable and non-exchangeable.
Certification Terms
BizCert Accreditation is valid for a period of three (03) years which is renewable subjected to compliance, assessment, investigation, feedbacks (including but not limited to complaints, if any) and any other accompanying factors that may determine the business’s certification status. The BizCert assessment and certification unit reserves its rights to revoke, suspend or bar the business from such certification should the business fails to comply to the standards and compliances set by the Association of Trade & Commerce (Singapore) and/or the relevant governing authorities.
Businesses who have made changes to its business information (ie: ownership, directors, shareholders, operating premise) may be required to undergo reassessment by the BizCert assessment and certification unit. In any event where such changes are being effect, the BizCert assessment and certification unit is to be notified in writing (ie: email) within twenty-one (21) days of such changes being in effect.
BizCert Standards
Businesses are required to maintain the BizCert standards as stated in the assessment criteria provided (also available on the Association of Trade & Commerce (Singapore) website). The criteria may be revised from time to time and accredited businesses are bound by such criteria at all times.
Upon approval and handover of the BizCert Accreditation status, businesses are required to display the BizCert Accreditation clearly in their operating premise. Certification policies are to be made easily accessible to consumers, customers and members of the public through online or printed media.
Businesses are required to comply with all regulatory and governmental compliances, laws and regulations at all times. In the event where the Association of Trade & Commerce (Singapore) is being notified of such breach(es), the accredited business shall be suspended, barred and/or terminated from the certification scheme with immediate effect. Businesses that such breach(es) may be blacklisted, dependent on the severity of the non-compliance, or by any other appropriate means.
Businesses must maintain its standards in complaint management and have at all times, its complaint management system in place. It is acknowledged that members of the public may file a complaint against the accredited business via the Association of Trade & Commerce (Singapore) – Complaints & Mediation Clinic and if such complaint is to be filed, the accredited business may be called for investigation and further resolution actions may be requested (ie: mediation session), at the sole discretion of the Association of Trade & Commerce (Singapore) Complaints & Mediation Unit.
Accredited businesses shall adhere to the BizCert Accreditation - Code of Practice. Should any breach(es) and/or infringement in the code of practice be found, penalties may be imposed upon such breach and/or infringement.
Audit & Investigation
Accredited business is informed and agrees that the Association of Trade & Commerce (Singapore) assessment unit is empowered to deal with any breach(es) or infringement of the BizCert Accreditation – Code of Practice and/or accompanying regulatory compliances. In an event where an accredited business is found to have breached and/or infringed any of such clause, the accredited business shall be suspended, barred and/or terminated from the certification scheme with immediate effect.
An audit and/or investigation shall be effected upon such breach and it is acknowledged that the business will be required to comply to such audit and/or investigation.
Accredited businesses who have breached and/or infringed the BizCert Accreditation – Code of Practice and/or accompanying regulatory compliances will be required to undergo a full assessment to enable reinstatement of its BizCert Certification. However, such reinstatement shall be at the sole discretion of the BizCert Assessment & Certification Unit and shall be dependent on the severity of such breach(es) and/or infringement.
Businesses shall allow Association of Trade & Commerce (Singapore) officers, representatives and/or authorised agent(s) into its business premises for the purpose of audit and/or investigation.
Indemnity & Termination
The business agrees to indemnify and keep the Association of Trade & Commerce (Singapore), its directors, employees, officers, agents and/or representatives fully and effectively indemnified against any and all actions, liabilities, cost, claims (including but not limited to third party), losses, damages, proceedings and/or expenses (including but not limited to legal costs) arising from or in connection with the business’s application under the BizCert Accreditation scheme.
Upon termination and/or expiry of the BizCert Accreditation scheme, the business shall cease usage or representation of any and all BizCert materials, unless otherwise approved by the Association of Trade & Commerce (Singapore).
The Association of Trade & Commerce (Singapore) reserves its rights to immediate revocation of the certification status of a business without any notice should the accredited business be found to have breached or infringed any the BizCert Accreditation Policies, Code of Practice, regulatory compliances or for whatsoever reasons, as the BizCert assessment unit deems fit.
